Real Estate

The firm has extensive experience in residential and commercial real estate transactions on behalf of developers, buyers, sellers, borrowers in loan transactions, landlords and tenants. Firm attorneys Catherine W. Scott and Peter H. Carter represent clients with respect to all aspects of a real estate purchase or sale transaction, including the negotiating and drafting of purchase and sale contracts, addressing business formation issues which arise in real property transactions, forming condominiums, drafting easements and restrictive covenants, determining the state of title and addressing any title issues, determining the status of permits on real pro[pertyu, asssisting clients in obtaining necessary permits and addressing any permit problems which arise in the course of a transaction, and the drafting and review of various closing documents. Additonally, where a residential or commercial transaction involves financing or refinancing, firm attorneys are frequently involved in reviewing and negotiating bank documents and providing the bank with the title evidence, opinion letters and resolution required by the lender.

Both Ms. Scott and Mr. Carter have substantial experience representing landowners in transactions involving conservation easements and the conveyance of development rights, and Ms. Scott has considerable experience in the area of affordable housing through her longtime representation of the owner and developer of numerous affordable housing units throughout the Upper Valley.
